High-Wage Job Offer

Each province and territory has a median hourly wage as determined by Statistics Canada. An employer who is offering a wage that is above or at the median hourly wage should submit an application that meets the program requirements for the High-wage position.

This process requires the employer to obtain a Labor Market Impact Assessment (LMIA) demonstrating that the employer was not able to find a Canadian worker or permanent resident to fill the position and perform the duties required by the job.

Requirements for High-wage job offer

Here are some of the requirements for employers who want to hire a temporary foreign worker:

Employers must supply documents along with their Labour Market Impact Assessment (LMIA) application to demonstrate that their business and job offers are legitimate.
Transition Plan, validating the duration of the employment of the temporary foreign worker.
Employers must complete a ‘transition plan’ that will explain how the employer intends to permanently fill the job being held by the temporary foreign worker.
Wages offered to temporary foreign workers should be similar to wages paid to Canadian and permanent resident employees hired for the same job and work location, and with similar skills and years of experience.
Employers must ensure that the temporary foreign workers they want to hire under the Temporary Foreign Worker Program are covered by the provincial or territorial workplace safety insurance provider, as required by law.

Procedures for Employers hiring a Temporary Worker for High-wage position

The employer who is ready to hire a temporary worker for a high-wage position must also remember the following:

Employers must complete a ‘transition plan’ that will explain how the employer intend to permanently fill the job being held by the temporary foreign worker.
Employers are required to keep more detailed records during the foreign worker’s stay in Canada.
Certain applications will be processed more quickly. Foreign workers in skilled trades, high paid workers with salaries in the top 10% of Canadian earnings, and workers coming for 120 days or less will all receive LMIA decisions in 10 business days.
A new time limit for high-wage work permits may be imposed, but has not yet been announced.
